HUAWEI OCTOBER NEW ARRIVALS TERMS AND CONDITIONS

1. Introduction

This HUAWEI OCTOBER NEW ARRIVALS Campaign (“Campaign”) is organized by HUAWEI Technologies (Malaysia) Sdn. Bhd. (“Organiser”). This Campaign will run from 26th October 2020, 12:00 AM (GMT+8) until 1st November 2020,  11:59 PM (GMT+8) (“Campaign Period”). Organiser reserves the rights to shorten or extend the Campaign Period at any time without notice.

This Campaign will run the Events during the respective Event Period as set out in section 3 below.

2. Campaign Mechanism

This Campaign is open to all registered customers of HUAWEI Store on the website, https://shop.HUAWEI.com/my (“HUAWEI Store”) who are residents of Malaysia, and  aged 18 years old and above as of 26th October 2020 (“Customer(s)”).

Customer must login to HUAWEI Store to participate in this Campaign.

3. Campaign Events

i.Pre-Order

a. The Pre-Order event will run from 26th October 2020, 00:00AM (GMT+8) to 29th October 2020, 23:59PM (GMT+8) only (“Pre-Order Period”).

b. Pre-Order Products will be available for pre-order by Customer with the corresponding Free Gifts as set out in the following table on Huawei Store during the Pre-Order Period:-

c. Free Gifts are not exchangeable for cash or other items, and are non-transferable.

d. Free Gifts are not covered by warranty.

e. Free Gifts are available on a first-come-first-served basis, while stocks last.

f. Any Pre-Order Products ordered under this Pre-Order event will only be shipped out of Organiser’s warehouse from 30th October 2020 onwards.

g. The offers under this Pre-Order event is only applicable to purchases of the Pre-Order Products made on the HUAWEI Store.

h. The offers under this Pre-Order event cannot be enjoyed with any other offers, vouchers, promotions or rebates applicable on HUAWEI Store.

ii.New Arrivals

a. This New Arrivals event will run from 30th October 2020, 00:00AM (GMT+8) to 1st November 2020, 23:59PM (GMT+8) (“New Arrivals Period”).

b. Customer who purchases New Arrivals Products within the New Arrivals Period will receive the corresponding Free Gifts as set out in the following table:-

c. Free Gifts are not exchangeable for cash or other items, and are non-transferable.

f. The offers under this New Arrivals event is only applicable to purchases of the New Arrivals Products made on the HUAWEI Store.

g. The offers under this New Arrivals event cannot be enjoyed with any other offers, vouchers, promotions or rebates applicable on HUAWEI Store.

4. General

a) All offers, free gifts and vouchers available through this Campaign are applicable only to purchases made on the Huawei Store.

b) The Customer agrees and provides consent to Organiser to the use of any Personal Data as provided by the Customer for the purpose of participation in this Campaign in line with the Personal Data Protection laws and regulations, to the extent that any personal data provided shall only be processed and be used by Organiser for lawful purpose directly related to the running of this Campaign including but not limited to the purposes of promotional events, advertising, marketing and any administrative matters to facilitate the management and organizing of this Campaign.

c) By providing the personal data, Customer indicates that he/she has read, understood and agreed to be bound by Organiser’s Privacy Policy stated at https://shop.huawei.com/my/cmsContent?key=web_cms_privacy . The Customer agrees that Organiser and/or its agent and/or its third party service providers may contact them by telephone, email or such other method in connection with this Campaign.

d) In the event any voucher, free gift or prizes are being awarded to the Customer having provided false or mistaken identity or information, Organiser shall have the right to revoke the Customer’s eligibility for the said voucher, free gift or prizes.

e) By participating in the Campaign, Customers agree to be bound by this Terms and Conditions and Organiser’s decisions are final and binding. No correspondence or appeals will be entertained. Organiser reserves the right to the final and ultimate interpretation of this Campaign.

f) In accepting the voucher, free gift or prizes, the Customer agree to participate and cooperate as required in all editorial activities relating to the Campaign. The Customers agree to grant Organiser a perpetual and non-exclusive license to use such footage and photographs, voice, biographical information and/or statements, at any time or times, in all media types worldwide for advertising, trade, publicity and promotional purposes and the winners will not be entitled to any fee for such use.

g) Organiser assumes no responsibility for late entries due to any reasons including, but not limited to, network transmission failure.

h) Organiser shall not be responsible for any losses or damages directly or indirectly incurred by any party including the Customer in connection or arising from acts or omissions or in any way related to this Campaign.

i) The Customer agrees to discharge and release Organiser from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Campaign or to the Customer’s entry in the Campaign.

j) The Customer further agrees to discharge and release any third party which is related to and connected with this Campaign, including Facebook, from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Campaign or to the Customer’s entry in the Campaign.

k) Without prejudice to the foregoing and save where otherwise prohibited by law:- (i) in no event shall Organiser be liable to any party including the Participant for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, howsoever remote even if such losses were foreseeable or if Organiser were advised of the possibility of such damages; and (ii) if Organiser is adjudicated by a local court of competent jurisdiction to be liable for any losses or damages arising out of or is in any way connected to this Campaign and any events therein, Organiser’s total liability shall in no event exceed RM50.00.

l) By entering into this Campaign, the Customer agrees to indemnify and hold Organiser and the Organiser Group of Companies, their officers, directors, shareholders, predecessors, successors in title, employees, agents and representatives harmless from any claims, losses, damages, liability, claims or expenses (including any legal fees), suffered or incurred by Organiser due to or in any way arising from this Campaign.

m) If Customers are discovered to be using or have used improper means to participate in this Campaign, Organiser reserves the right to cancel the eligibility without notice including without hesitation, the commencement of legal proceedings under the full extent of the applicable laws.

n) All Customers are required to fill in their shipping address in order to complete the purchase.

o) To confirm order(s), Customers must make FULL payment within 2 Hours. Order(s) without FULL payment made shall be cancelled automatically after 2 hours.

p) Item(s) color may vary from the illustrated photo(s), depending on the computer / devices screen resolutions.

q) No cash alternative to the offers, vouchers or free gifts will be offered. The offers, vouchers and free gifts are not transferable and/or exchangeable, including color options. Offers, vouchers and free gifts are  subject to availability and we reserve the right to substitute any offers, vouchers or free gift with another of equivalent value without giving notice.

r) If offers, vouchers or free gifts are manufactured by third parties, no after-sales services are to be provided by Organiser to Customers and no warranty for the qualities of the offers, vouchers or free gifts.

s) All free gifts under this Campaign are not exchangeable for cash or other items, and are non-transferable.

t) All free gifts under this Campaign are not covered by warranty.

u) All free gifts under this Campaign are available on a first-come-first-served basis, while stocks last.

v) Any offer and promotion under this Campaign cannot be enjoyed together with any other offer and promotion of Organiser.

w) This Campaign and the Terms and Conditions herein shall be governed by the laws of Malaysia.

x) In the event where any product purchased is allowed to be returned by the Customer to Organiser according to its standard return policy, all free gifts given together with the product purchased must also be returned to the Organiser together.
