1. Introduction

    This HUAWEI Sound X Giveaway Contest (“Campaign”) is organized by Huawei Technologies (Malaysia) Sdn. Bhd. (“HUAWEI”). This Campaign will run from 18th December 2020, 10.00 am to 20th December 2020, 11.59pm (“Campaign Period”).HUAWEI shall reserve the right to shorten or extend the Campaign Period at its sole discretion without prior notice.

2.    Campaign Mechanism

    In order to participate in this Campaign, Participants are required to complete all the following steps: -

    a) Purchase one (1) unit of HUAWEI Mate 40 Pro from a participating HUAWEI Brand Store, HUAWEI Operator Store or HUAWEI Store online (https://shop.HUAWEI.com/my) in Malaysia;

    b) Download the HUAWEI Member Center mobile application from HUAWEI AppGallery onto the HUAWEI Mate 40 Pro purchased within the Campaign Period; and

    c) Complete the registration form on the Campaign page on HUAWEI Member Center with the required details within the Campaign Period.


    First one thousand (1,000) Participants who completed all steps set out in out (Campaign Mechanism) above will win one (1) unit of HUAWEI Sound X (“Prize”). Winners will be contacted by an authorized representative of HUAWEI within a week from the date of completing of the registration form.


3.    Eligibility

    a) This Campaign is open to individuals who are residents in Malaysia only.

    b) Participant must be eighteen (18) years of age and above as of 18th December 2020.

    c) Participant must be a registered user of HUAWEI Member Center with a valid HUAWEI ID to be eligible participate in this Campaign.

    d) Participant must have purchased a unit of HUAWEI Mate 40 Pro in Malaysia to be eligible participate in this Campaign. Original purchase receipt of HUAWEI Mate 40 Pro will be required to claim the Prize won.

    e) Only one (1) entry will be accepted per HUAWEI Mate 40 Pro (of the same SN Number) purchased.

    f) Each Participant with the same IC Number can submit a maximum of one (1) entry only.

    g) Each Participant with the same IC Number can win a maximum of one (1) Prize only.

    h) Multiple entries from the same Participant will be disqualified.

    i) HUAWEI reserves the rights to disqualify any Participant at its sole and absolute discretion, without having to assign any reasons whatsoever.

    j) By participating in this Campaign, Participants are deemed to have reviewed, read and accepted the Terms and Conditions.


4.    Winning Criteria

    a) First one thousand (1,000) Participants who completed all steps set out in out in Section 2 (Campaign Mechanism) above within the Campaign Period will win one (1) unit of HUAWEI Sound X (“Prize”).

    b) Winners of Prize will be contacted through his/her email address after end of Campaign Period as submitted at registration form of the Campaign page in HUAWEI Member Center.

    c) The decision of HUAWEI is final, and no enquiries, verbal or written, shall be entertained.


5. Prize

    a)The total number of Prizes available to be won under this Campaign is one thousand (1,000) units of HUAWEI Sound X only.

    b)The winner shall be responsible for all costs in connection with the redemption, collection, delivery and/or perfection of his/her Prize, including but not limited to legal cost, stamp duties, registration and transfer fees, taxes, insurance, spending money and related expenses (such as meals or personal expenses, upgrades, etc.) or fees. Collection/delivery of the Prize must be within Malaysia only.

    c)The Prize is not exchangeable, transferable or redeemable in any form for whatever reason.

    d Winner who fail to respond to the authorized representative of HUAWEI by 11.59pm, 14th January 2021 will be disqualified from receiving the Prize automatically. Any Prize not claimed by 11.59pm, 14th January 2021 shall be automatically forfeited. The Prize will thereafter be deemed to have lapsed unconditionally and irrevocably. The Prize shall be claimed personally by the Campaign winner. Winner whose Prize has been forfeited or unclaimed is not entitled to any payment or compensation from HUAWEI notwithstanding non-receipt of notification that he/she is a winner.

    f)The Prize will be shipped out to the winners only after 27th December 2020. Winner shall accept the Prize as it is. HUAWEI makes no representation, warranty or undertaking as to any implied terms and conditions with respect to the Prize in this Campaign.

    g)HUAWEI assumes no liability or responsibility in respect to defect or deficiency of the Prize or the nature/consumption of the Prize and will not entertain any direct correspondence with anyone in this regard.


6.    General

    a) The participant agrees and provides consent to HUAWEI to the use of any Personal Data as provided by the participant for the purpose of participation in this Campaign in line with the Personal Data Protection Act 2010, to the extent that any personal data provided shall only be processed and be used by HUAWEI for lawful purpose directly related to the running of this Campaign including but not limited to the purposes of promotional events, advertising, marketing and any administrative matters to facilitate the management and organizing of this Campaign.

    b) By providing the personal data, participant indicates that he/she has read, understood and agreed to be bound by HUAWEI’s Privacy Policy stated at https://consumer.huawei.com/my/legal/privacy-policy. The participant agrees that HUAWEI and/or its agent and/or its third-party service providers may contact them by telephone, email or such other method in connection with this Campaign.

    c) Winner may be required to participate in a photo taking session during the issuance of the prizes as collection proof upon collecting the prize.

    d) In the event any prize is being awarded to the participant having provided false or mistaken identity or information, HUAWEI shall have the right to revoke the participant’s eligibility for the said Prize.

    e) All prize images are for reference only. Prizes shown and/or represented for the running of this Campaign shall be subjected to availability. Prizes given are non-refundable.

    f) Prize winner shall not substitute any prize won or exchange the said Prize for money. HUAWEI reserves all rights in its sole discretion to substitute any prizes (or prize component, if applicable) with one of equal or greater value. HUAWEI is responsible only for the delivery of the Prize and is not responsible for the condition, quality and fitness of the said prize. Any imposition of taxes, fees, and any other costs associated with the acceptance and use of the prize is the sole responsibility of the prize winner.

    g) By participating in the Campaign, participants agree to be bound by this Terms and Conditions and HUAWEI’s decisions are final and binding. No correspondence or appeals will be entertained. HUAWEI reserves the right to the final and ultimate interpretation of this Campaign.

     h) In accepting the prize, the winner agree to participate and cooperate as required in all editorial activities relating to this Campaign. The winner agrees to grant HUAWEI a perpetual and non-exclusive license to use such footage and photographs, voice, biographical information and/or statements, at any time or times, in all media types worldwide for advertising, trade, publicity and promotional purposes and the winner will not be entitled to any fee for such use.

    i) HUAWEI assumes no responsibility for late entries due to any reasons including, but not limited to, network transmission failure.

    j) HUAWEI shall not be responsible for any losses or damages directly or indirectly incurred by any party including the participant in connection or arising from acts or omissions or in any way related to this Campaign.

    k) The participant agrees to discharge and release HUAWEI from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Campaign or to the Participant’s entry in the Campaign.

    l) The Participant further agrees to discharge and release any third party which is related to and connected with this Campaign, including Facebook, from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Campaign or to the Participant’s entry in the Campaign.

    m) By entering into this Campaign, the participant agrees to indemnify and hold HUAWEI and the HUAWEI Group of Companies, their officers, directors, shareholders, predecessors, successors in title, employees, agents and representatives harmless from any claims, losses, damages, liability, claims or expenses (including any legal fees), suffered or incurred by HUAWEI due to or in any way arising from this Campaign.

    n) If participants are discovered to be using or have used improper means to participate in this Campaign, HUAWEI reserves the right to cancel the eligibility without notice including without hesitation, the commencement of legal proceedings under the full extent of the applicable laws.

    o) Huawei reserves all the rights at all times to modify or amend the Terms and Conditions of this Campaign or to cancel it with immediate effect without giving any prior notice to any party

    p) This Campaign and the Terms and Conditions herein shall be governed by the laws of Malaysia.
